Terms of Service & Privacy Policy

TradeMyLease (the "Service") is owned and operated by MKN Web Solutions, LLC ("we," "us," "our"). By accessing or using TradeMyLease, you ("you," "user") agree to these Terms of Service and the Privacy Policy below. If you do not agree, do not use the Service.

Terms of Service

1. The Service

TradeMyLease is an online marketplace that connects drivers who want to transfer their existing car lease ("sellers") with drivers who want to take over a lease ("buyers"). The Service is offered through the website at trademylease.com. The Service consists of (i) listing tools sellers use to post leases, (ii) browse and search tools buyers use to find leases, (iii) messaging tools the parties use to communicate, and (iv) educational content about how lease transfers work at different banks.

What we are not. We are not a car dealer, automobile broker, lender, lease originator, lease servicer, escrow service, title agent, or insurance provider. We do not buy, sell, finance, or take title to any vehicle. We do not approve, deny, or process lease transfers — that is the role of the bank that originated the lease.

2. Eligibility & Accounts

You must be at least 18 years old and able to enter a legally binding contract to create an account. By registering, you represent that the information you provide is accurate and current. You are responsible for safeguarding your password and for any activity that occurs under your account.

3. User Content; Listings

The content you post — listing details, vehicle photos, vehicle descriptions, lease terms, asking prices, messages to other users — is your "User Content." You retain ownership of your User Content. By posting it, you grant MKN Web Solutions a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and (for listings) publicly display it solely for the purpose of operating the Service and providing the marketplace function.

Listings are public. Listings posted on TradeMyLease are visible to anyone on the internet — they are indexed by search engines and may appear in third-party search results, social previews, or aggregator sites. Do not post anything in a listing (including in photos or descriptions) you don't want publicly visible. Personal contact information (full name, phone, email, exact street address) is not collected as part of a listing and should not be included in the description.

Accuracy is your responsibility. You represent and warrant that every fact in your listing — make, model, year, trim, mileage, monthly payment, remaining months, lease bank, residual, money factor, condition, and any other fact — is accurate, complete, and not misleading. Misrepresenting a vehicle or its lease terms is a violation of these Terms and may also be unlawful.

You own the right to transfer. You represent that you are the original lessee (or co-lessee with authority to act) on the lease you list, that your lease account is in good standing, and that your bank permits lease transfers under the terms of your specific lease agreement. We do not verify any of this.

4. Third-Party Information Disclaimer

The Service displays and aggregates information from many third-party sources, including but not limited to:

• Lease bank policies — transfer fees, approval timelines, eligibility requirements, and processes published or communicated by Ford Credit, GM Financial, BMW Financial Services, Toyota Financial Services, Honda Financial Services, and other captive lease finance companies.
• Seller-submitted listing data — vehicle make, model, year, mileage, condition, photographs, monthly payment, remaining lease term, and other details posted by individual sellers.
• Public vehicle data — manufacturer specifications, trim packages, standard features.
• Educational content — articles, guides, and FAQ pages summarizing how lease transfers generally work at various banks.

All third-party information is provided "as is." We do not verify, audit, endorse, or guarantee the accuracy, completeness, or currency of any third-party information displayed on the Service. Bank policies and fees change frequently and without notice; what is posted on the Service may be outdated, incomplete, or incorrect for your specific lease. Vehicle data submitted by sellers may be inaccurate or misleading. Manufacturer specifications change between model years and trim packages.

Before relying on any information on the Service, you must independently verify it with the original source — your lease bank's customer service line for policy questions, the seller and a personal pre-purchase inspection for vehicle questions, and the manufacturer's official materials for vehicle specifications. We expressly disclaim all responsibility and liability for losses, damages, or decisions arising from reliance on third-party information displayed on the Service.

5. Trademarks; No Endorsement or Affiliation

Automotive trade names, model names, and logos appearing on the Service — including but not limited to BMW, Mercedes-Benz, Audi, Porsche, Volvo, Ford, Lincoln, Chevrolet, GMC, Cadillac, Buick, Chrysler, Jeep, Ram, Dodge, Toyota, Lexus, Honda, Acura, Nissan, Infiniti, Hyundai, Kia, Genesis, Mazda, Subaru, Tesla, and any other automotive brand name — are the registered trademarks or trade names of their respective owners. They are used on the Service solely for descriptive purposes — to identify the make, model, year, or financing arm of a vehicle being listed or discussed — under the doctrine of nominative fair use.

We claim no ownership of any automotive trademark or trade name, no license from any car manufacturer, and no commercial relationship with any car manufacturer or captive financing company.

TradeMyLease is an independent, third-party marketplace. We are not affiliated with, endorsed by, sponsored by, certified by, or otherwise authorized by any car manufacturer, lease bank, captive financing company, or any of their parents, subsidiaries, or affiliates. Any reference to a manufacturer or lease bank on the Service is purely informational. The presence of a brand name does not imply any partnership, approval, certification, or endorsement of the Service by that brand.

6. Our Role; What We Do Not Do

TradeMyLease provides a venue where sellers and buyers can find each other. We do not:

• Inspect, certify, or warrant any vehicle's mechanical condition, cosmetic condition, mileage, or accident history;
• Verify the accuracy of any listing, lease term, monthly payment, residual value, money factor, mileage allowance, or remaining months;
• Verify the identity, creditworthiness, financial standing, or intent of any user;
• Negotiate the transfer between buyer and seller;
• Handle the lease bank's approval process — the bank credit-checks the buyer and approves or denies the assumption based on its own criteria;
• Process payments between buyer and seller, including any cash incentives, transfer fees, or shipping costs;
• Provide financing, lending, escrow, insurance, registration, title transfer, shipping, or any related service;
• Act as an agent, broker, fiduciary, or representative of either party.

The agreement to assume a lease is made directly between the original lessee, the assuming lessee, and the lease bank under the bank's standard transfer paperwork. We are not a party to that agreement.

7. No Financial, Legal, or Tax Advice

Information on the Service — including articles, guides, brand-by-brand transfer pages, FAQ answers, calculators, and any communications from us — is provided for general informational purposes only. It does not constitute financial advice, legal advice, tax advice, accounting advice, or professional advice of any kind. We are not your attorney, accountant, financial advisor, or tax professional. Before making decisions about a lease transfer, consult a qualified professional licensed in your jurisdiction.

8. Bank Approval & Lease Assumption Risk

Whether a lease transfer is approved is entirely the lease bank's decision, based on its own credit, income, and underwriting standards. We have no role in, and no ability to influence, the bank's decision. Approval timelines vary by bank, and the published "typical" timelines on the Service are approximations only.

Whether the original lessee is released from liability after a transfer depends entirely on the lease bank's policy and the specific transfer paperwork. Some banks issue a full release; some (notably Nissan Motor Acceptance Corporation and certain regional/state programs) keep the original lessee on the lease as a guarantor. The descriptions on the Service summarize what we have observed but do not guarantee outcome. Original lessees must read and understand the transfer paperwork they sign before completing any transfer.

9. Permitted Use

You may use the Service for personal, non-commercial purposes — listing your own lease for transfer, browsing leases that interest you, communicating with counterparties about a possible transfer, and reading educational content. Licensed dealers and other commercial users may use the Service only with our prior written consent and only under separate commercial terms.

10. Prohibited Use

You may not, and may not permit anyone else to:

• List a vehicle you do not have legal authority to transfer, or a lease that is not in good standing;
• Post content that is false, misleading, deceptive, defamatory, harassing, obscene, infringing, or that violates any third party's privacy or intellectual-property rights;
• Use the Service to engage in fraud, money laundering, identity theft, or any unlawful activity;
• Bypass the Service to avoid fees you have agreed to pay us (if any), or to mislead the bank or the counterparty about the nature of the transfer;
• Attempt to gain unauthorized access to the Service, other users' accounts, servers, or networks;
• Scrape, copy, or harvest listings, user data, or content in bulk;
• Interfere with or disrupt the Service, including by introducing viruses, denial-of-service attacks, or excessive automated requests;
• Reverse engineer, decompile, or attempt to derive the source code of the Service except where such restriction is prohibited by law;
• Resell, sublicense, or commercially exploit the Service without our prior written consent;
• Use the Service to send unsolicited commercial communications to other users.

11. Intellectual Property

The Service, including all software, designs, original text, graphics, layouts, and the TradeMyLease name and logo, is owned by MKN Web Solutions, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. Except for the limited rights expressly granted to you in these Terms, no rights are granted in or to the Service.

As stated in Section 5, automotive trademarks and trade names appearing on the Service belong to their respective owners and are used solely for descriptive purposes under the doctrine of nominative fair use.

12. Copyright Complaints (DMCA)

If you believe that content on the Service infringes your copyright, please send a written notice that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) to dmca@mkn.us. Your notice must include: (a) a physical or electronic signature of the copyright owner or their authorized agent; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and where it appears on the Service (URL); (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

13. Service Provided "AS IS"

THE SERVICE, INCLUDING ALL LISTINGS, THIRD-PARTY INFORMATION, BANK-POLICY SUMMARIES, EDUCATIONAL CONTENT, AND USER COMMUNICATIONS, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. MKN WEB SOLUTIONS, LLC SPECIFICALLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TITLE, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY LISTING, VEHICLE DESCRIPTION, LEASE TERM, BANK POLICY, FEE AMOUNT, EDUCATIONAL CONTENT, OR ANY OTHER INFORMATION DISPLAYED ON OR TRANSMITTED THROUGH THE SERVICE. WE DO NOT WARRANT THE CONDUCT, IDENTITY, OR INTENT OF ANY USER.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MKN WEB SOLUTIONS, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION ANY MISREPRESENTATION OF A VEHICLE OR LEASE TERM, ANY FAILED OR DELAYED LEASE TRANSFER, ANY DENIAL OF CREDIT BY A LEASE BANK, ANY UNDISCLOSED VEHICLE CONDITION, ANY DISPUTE BETWEEN BUYER AND SELLER, OR ANY GUARANTOR LIABILITY ARISING FROM A BANK'S TRANSFER POLICY;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
• RELIANCE ON ANY BANK-POLICY SUMMARY, FEE FIGURE, EDUCATIONAL ARTICLE, OR OTHER INFORMATION ON THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless MKN Web Solutions, LLC and its affiliates from and against third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) to the extent arising from: (a) your unlawful conduct; (b) your knowing or reckless violation of these Terms; (c) your misrepresentation of any vehicle or lease term you list; (d) any dispute between you and another user; or (e) your upload of content that infringes another person's intellectual-property, privacy, or other rights. This obligation does not apply to claims based on our own negligence, willful misconduct, or material breach of these Terms.

16. Termination & Service Discontinuation

You may delete your account at any time from your account settings. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or use the Service in a manner that creates risk for us or other users.

If we discontinue the Service (in whole or in a way that materially affects your account), we will give you reasonable advance notice by email and an in-app notice when feasible. Upon termination of your account, your right to use the Service ends immediately. Sections 3 (last paragraph), 4, 5, 6, 7, 8, 11, 13, 14, 15, and 19 survive termination.

17. Modifications to the Service or Terms

We may modify the Service or any feature of it at any time. We may revise these Terms from time to time; the most current version will always be posted at /terms with an updated effective date. If we make a material change, we will make reasonable efforts to notify you (for example, by email or an in-app notice). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

18. Governing Law & Disputes

These Terms are governed by the laws of the State of California, U.S.A., without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

19. Miscellaneous

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be deemed a waiver. You may not assign these Terms without our prior written consent; we may assign them freely. These Terms (together with the Privacy Policy below) constitute the entire agreement between you and us with respect to the Service and supersede any prior agreements.

Privacy Policy

20. Information We Collect

Account information. When you register, we collect your name, email address, and a hashed password. We never store your password in plain text.

Listing content. When you post a listing, we store the vehicle and lease information you provide, including photos. Listings are public by design.

Messages. Inquiry messages between buyers and sellers are stored on our servers so both parties can refer back to them.

Usage information. We log standard request data (IP address, user-agent string, timestamp) for security, debugging, and abuse prevention.

Cookies. We use a small number of essential cookies to keep you signed in and to remember your preferences. We do not use third-party advertising cookies. We may use a limited set of analytics cookies (e.g., Google Analytics) to understand how the Service is used in aggregate; these do not identify you personally.

21. How We Use Your Information

• To provide, maintain, and improve the Service;
• To authenticate you and prevent unauthorized access to your account;
• To send you transactional email (verification, inquiry notifications, password resets);
• To investigate and prevent fraud, abuse, or violations of these Terms;
• To send occasional product announcements (you can unsubscribe at any time);
• To comply with legal obligations.

We do not sell your personal information. We do not share your account information with advertisers or data brokers for marketing.

22. What's Public vs. Private

Public: the vehicle information, photos, and lease terms in your listing; your listing's URL (which is indexable by search engines); the city and state on your listing.

Private until you choose to share: your account email, full address, phone number, the content of your inquiry messages, your account password (which we never see). Your contact details are not revealed to another user until you and the other party have engaged in conversation and you've decided to share them.

23. Sharing

We may share information only:

• Publicly, as part of your listing (vehicle data, photos, city/state). Listings are designed to be public.
• With your counterparty, when you send or receive an inquiry message. The other party sees your display name and the message contents.
• With infrastructure providers we use to operate the Service (currently: cloud hosting, file storage, transactional email delivery, server monitoring). These providers process data only on our instructions and are contractually prohibited from using your data for their own purposes.
• With analytics services (e.g., Google Analytics) in an aggregated and de-identified form to help us understand Service usage.
• If required by law, court order, or to protect the rights, property, or safety of MKN Web Solutions, LLC, our users, or the public;
• In connection with a merger, acquisition, or sale of assets, in which case we will provide notice before your information is transferred and becomes subject to a different privacy policy.

24. Data Storage & Security

Your data is stored on infrastructure operated by MKN Web Solutions, LLC. We use TLS 1.2 or higher to encrypt data in transit, encryption at rest for database and file storage, and modern bcrypt password hashing. We follow the security and infrastructure standards published at mkn.us/software-security and mkn.us/infrastructure.

Breach notification. If we become aware of a security breach that affects the confidentiality, integrity, or availability of your personal information, we will notify affected users by email without unreasonable delay, and in any event as required by applicable law.

No system is perfectly secure. While we take reasonable measures to protect your data, you use the Service at your own risk.

25. Data Retention

We retain your account information for as long as your account is active. If you delete your account, we will delete or de-identify your personal information from our active systems within 30 days, except where we are required to retain it to comply with legal obligations, resolve disputes, or enforce our agreements.

Listings and messages. Sold, expired, or removed listings may be retained in archived form for up to 12 months for fraud-prevention and dispute-resolution purposes, then de-identified or deleted. Inquiry message threads may be retained for up to 24 months for the same reasons.

Backups. We keep encrypted backups for disaster recovery. Deleted content may persist in those backups for up to 90 days after deletion before it cycles out, after which it is permanently destroyed.

Server logs are retained for up to 90 days for security and debugging.

26. Your Rights

Depending on where you live, you may have rights under applicable data-protection law to access, correct, port, or delete the personal information we hold about you, or to object to certain processing. You can exercise most of these rights directly inside the application (account settings, listing deletion, account deletion). For requests we cannot fulfill in-app, email privacy@mkn.us.

27. Children

The Service is not directed to children under 18. We do not knowingly collect personal information from anyone under 18. If you believe a person under 18 has created an account, please contact us and we will promptly delete the account.

28. International Users

The Service is operated from the United States and is intended for U.S.-market lease transactions. By using the Service, you consent to the transfer, storage, and processing of your information in the United States, which may have different data-protection laws than your country of residence.

29. Changes to this Policy

We may update this Privacy Policy from time to time. The most current version is always at /terms, with an updated effective date. Material changes will be communicated to you in the application or by email.
